Senator Huffines Fights For Second Amendment Rights & Civil Liberties
Won Six-Hour Debate on an Amendment to Open Carry Bill.
Austin- Senator Don Huffines (R - SD 16) passed an amendment to HB 910 which will prevent undue and unconstitutional harassment of gun owners by providing that "a peace officer may not make an investigatory stop or other temporary detention to inquire as to whether a person possesses a handgun license solely because the person is carrying" the handgun openly and in accordance with Texas' open carry law. The amendment was originally filed by Rep. Harold Dutton and Rep. Matt Rinaldi and passed in the House by 133-10 votes. The amendment passed in the Senate by 20-11.
"As we expand Second Amendment liberty with HB 910, we must remain mindful of the civil liberties safeguarded by the Fourth Amendment," said Senator Huffines. "Texans who choose to carry openly once this bill is signed by Governor Abbott should not be suspect, and should not be detained, delayed, or searched simply because they choose to exercise their Second Amendment right. We have a duty to protect the civil liberties of Texans who choose to open carry. I am proud that my fellow Senators joined me in adopting this amendment. With the signing of HB 910, we will take another major step in advancing our Second Amendment rights."
